Money Laundering Crimes in UAE Law

Federal Decree-Law No. (20) of 2018 sets out a strict legal framework for combating money laundering in the UAE, aligned with FATF standards — balancing compliance obligations on businesses with severe criminal penalties for anyone found involved.

Money laundering under UAE law is the crime of concealing or disguising the illicit origin of funds so they appear to come from a legitimate source, and it is governed chiefly by Federal Decree-Law No. (20) of 2018 on Anti-Money Laundering. The United Arab Emirates has positioned itself as a regional and global pioneer in combating this crime, with its judicial and regulatory authorities enforcing the law in line with international standards issued by the Financial Action Task Force (FATF).

The legal system for combating these crimes rests on advanced legislation, most notably Federal Decree-Law No. (20) of 2018 on Combating Money Laundering, the Financing of Terrorism and the Financing of Illegal Organisations, together with its amendments and executive regulations.

Legal definition of the offence: Money laundering is defined as any act intended to conceal or disguise the illicit origin of funds, or to acquire, possess, or use them while knowing that they are derived from a felony or misdemeanour.

Elements of the Offence under UAE Legislation

For an act to be characterised as money laundering before UAE courts, specific elements defined by law must be present:

  • Actus Reus (Material Element)

Carrying out banking or commercial transactions (such as deposits, transfers, conversions, or disguising) with the aim of giving funds derived from an illicit source ("dirty money") an appearance of legitimacy.

  • Mens Rea (Criminal Intent)

Definite knowledge that the funds in question are proceeds of an unlawful criminal source, combined with intent to conceal them or recycle them.

Strict Penalties and Sanctions against Money Laundering

The UAE legislator has imposed severe, highly deterrent penalties on anyone found involved in money laundering crimes, with penalties extending to individuals, corporate entities, and companies:

Penalties for individuals: imprisonment for extended periods reaching several years, alongside substantial fines starting from hundreds of thousands and reaching millions of UAE dirhams.

Penalties for companies and institutions: dissolution of the legal entity (the company), confiscation of funds and proceeds of crime, and closure of the implicated business premises.

The Role of Regulatory Bodies and Financial Compliance

Regulatory bodies in the country — such as the UAE Central Bank, the Ministry of Economy, and the securities authorities — impose strict obligations on various business sectors, including financial institutions, lawyers, auditors, and dealers in gold and real estate:

Reporting suspicious transactions (STRs): requiring companies to apply the "Know Your Customer" (KYC) system and to immediately report any unexplained financial flows.

Conclusion

The legal system for combating money laundering in the UAE reflects the country's firm commitment to building a safe and clean investment environment free of financial crime. Compliance with the laws in force and the adoption of transparency standards is the first line of defence protecting companies and individuals from strict legal accountability.
