Medical Malpracticein UAE Law

Federal Law No. (4) of 2016 on Medical Liability draws a careful line between an unfortunate outcome and a genuine medical error — and between civil compensation and criminal accountability.

Medical malpractice under UAE law is a breach of the duty of care owed by a healthcare practitioner or facility to a patient, governed by Federal Law No. (4) of 2016 on Medical Liability. The law is built to work both ways: protecting patients' right to compensation when something genuinely goes wrong, while shielding physicians who follow accepted professional standards from unfair blame when treatment doesn't go as hoped.

What Actually Counts as a Medical Error

Under Article 6 of the law, not every disappointing outcome is a punishable medical error. The law reserves that label for errors that stem from a practitioner lacking technical knowledge expected of someone at their level and specialization, failing to follow recognized professional and medical standards, failing to exercise the necessary level of care, or acting negligently without proper caution and diligence.

The distinction that matters most here: the law penalizes a departure from accepted standards, not simply a bad result. If a physician follows sound medical principles and exercises appropriate care, but a recognized complication occurs anyway during treatment or surgery, that is not treated as medical error.

Two Tracks of Liability

  • Civil liability (compensation)

Civil liability exists to compensate the patient for material or moral damage suffered, built on three elements — fault, damage, and a causal link between them. Because the law requires doctors and healthcare facilities to carry liability insurance against medical errors, affected patients have a clearer path to actually recovering compensation.

  • Criminal liability (penal sanctions)

Criminal accountability is reserved for gross medical errors, not minor ones — minor errors are generally handled through disciplinary or civil routes instead. Cabinet Resolution No. (40) of 2019, the law's executive regulations, gives concrete examples of gross error: causing the death of a patient or fetus, mistakenly removing a healthy organ or causing an organ to lose function, severe negligence such as leaving surgical instruments inside a patient, or a physician practicing while under the influence of drugs or alcohol.

The Medical Liability Law reflects a genuine attempt to balance two priorities at once: strong, insured protection for patients, and fair treatment of physicians who meet professional standards, backed by technical expert review before any criminal accountability is imposed. Understanding where the line falls is the first step for any patient or practitioner navigating a possible malpractice claim.
