Divorce under UAE law: the basics
Divorce in the UAE is handled by the Personal Status Courts of each emirate. In Dubai, that means the Personal Status Court of Dubai Courts, which hears cases in Arabic. The rules that apply depend on your religion and, for expatriates, sometimes on your nationality.
For Muslims, Federal Decree-Law No. 41 of 2024 on Personal Status has applied since 15 April 2025. It recognises five ways a marriage can end: divorce by the husband, judicial divorce, khula, annulment, and death of a spouse. For non-Muslims, Federal Decree-Law No. 41 of 2022 on Civil Personal Status allows either spouse to ask the court for a divorce and treats men and women equally. In Abu Dhabi, non-Muslims can use the Abu Dhabi Civil Family Court under Abu Dhabi Law No. 14 of 2021.
Whatever route applies, a divorce in the UAE is only legally complete when it is documented by the court. The 2024 law requires divorce and any reconciliation to be documented at the competent court within 15 days, and a husband who delays documentation can be ordered to compensate his wife.

The divorce process in Dubai, step by step
- Legal consultationWe confirm which law applies, what you are entitled to, and whether a negotiated settlement is realistic.
- Prepare documentsMarriage certificate, passports, Emirates IDs, children's birth certificates and proof of income. Foreign certificates need legalisation and certified Arabic translation.
- Open a Family Guidance fileThe case is registered with the Family Guidance and Reconciliation section, which invites both spouses to sessions.
- Reconciliation sessionsA family counsellor meets the spouses together or separately. If they agree to divorce, the counsellor records a settlement covering custody, maintenance and other terms.
- Settlement approved or referral issuedAn agreed settlement is approved by a judge and becomes enforceable. If there is no agreement, the section issues a referral letter for court.
- File the divorce claimWe file the claim with the Personal Status Court, together with related claims such as custody, maintenance and housing.
- Hearings, arbitration and judgmentIn harm-based cases the court appoints arbitrators, who must try to reconcile the spouses within 60 days, before the court rules.
- Appeal and enforcementEither party may appeal, generally within 30 days. Final orders on maintenance, custody and visitation are enforced through an execution file.

These are typical estimates. The biggest causes of delay are missing or unattested documents, a spouse who does not attend, requests for expert or social reports, and appeals.
Financial rights on divorce
- Deferred dowry: any deferred dowry in the marriage contract becomes payable on divorce.
- Iddah maintenance: a wife divorced by her husband is generally entitled to maintenance during the waiting period.
- Mut'ah compensation: where a husband divorces his wife without her request and without a valid reason, the court can award additional compensation, based on his means and the length of the marriage.
- Child maintenance: the father remains responsible for the children's maintenance, including food, clothing, housing, schooling and medical care.
- Custodial housing: the mother with custody is usually entitled to suitable housing for the children, or a housing allowance.
- Jointly owned assets: property registered in both names, or assets bought with both spouses' money, can be divided by agreement or claimed through separate civil proceedings.

- Court fees: Dubai Courts charge a fixed fee for a divorce claim and fees based on value for financial claims such as deferred dowry or unpaid maintenance. You can confirm the current amount with the fee calculator on the Dubai Courts website.
- Translation and attestation: foreign marriage certificates must be legalised in the country of issue, attested in the UAE and translated into Arabic by a Ministry of Justice licensed translator.

Divorce for expatriates and non-Muslims
Expatriates who live in the UAE can usually divorce here, even if they married abroad. Non-Muslim couples can rely on the civil personal status law, which allows either spouse to request divorce and provides for joint custody. In some cases a couple can instead ask the court to apply the law of their home country, which may matter for asset division. If one spouse lives abroad, the court can serve them through official channels, which adds time. A UAE divorce judgment may need to be recognised in your home country, so we plan for that from the start.
