Divorce is defined in Article 53 of the UAE Personal Status Law as the dissolution of a marriage contract by the husband, through words indicating divorce, whether spoken or written. More broadly, it refers to the termination of the marital relationship — either at the will of one spouse or by mutual agreement — carried out through legally recognized procedures designed to balance both spouses' rights while protecting the interests of any children involved.
Two Main Types of Divorce
-
Revocable divorce (Talaq Raj'i)
Does not immediately end the marriage. The husband can return his wife to the marriage during the waiting period (iddah) without needing a new marriage contract.
-
Minor irrevocable divorce (Ba'in Baynunah Sughra)
Applies to a first or second divorce where the couple does not reconcile during the waiting period. The wife can return only through a new marriage contract and a new dowry.
-
Major irrevocable divorce (Ba'in Baynunah Kubra)
Occurs after a third divorce. The wife cannot remarry her former husband unless she first validly marries someone else and that marriage later ends naturally after being consummated.
When Can a Wife Petition for Divorce?
A wife can bring a divorce case before the court on several recognized grounds, including harm or abuse, the husband's failure to provide financial support, his prolonged absence, his disappearance, or his imprisonment.
